City Council voted 9-1-1 this morning to create a new affordable housing density bonus ––dubbed DDB90 –– that largely resembles the VMU2 program that was struck down in court late last year.
However, properties will only be eligible to participate in the program if they have the right zoning. This is a key distinction from VMU2, which was automatically applied to the hundreds (or thousands?) of properties around the city that already had VMU zoning. But this was what got the city in trouble with the courts ...
